Terms and Conditions

Welcome to Molly Van Rijssen Expressive Counseling, LLC (“I,” “me,” or “my”). By accessing or using my services (the “Services”), you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

1. Scope of Services

1.1 Description: Services include art therapy sessions, transpersonal counseling, and related support services tailored to your individual needs. These sessions may occur in person, online, or via other agreed-upon formats.

1.2 Not a Substitute for Medical Care: Services are designed to support mental, emotional, and spiritual well-being but are not a substitute for medical diagnosis, treatment, or emergency care.

2. Eligibility

2.1 Age Requirement: Clients must be 18 years or older to engage in our Services unless written consent is provided by a parent or legal guardian.

2.2 Accuracy of Information: You agree to provide accurate, current, and complete information during the intake process and to notify me of any changes relevant to your care.

3. Appointments and Cancellations

3.1 Scheduling: Appointments must be scheduled in advance. Session times and durations will be agreed upon between client and therapist.

3.2 Cancellation Policy: Cancellations or rescheduling requests must be made at least 48 hours before the scheduled appointment. Failure to do so may result in a cancellation fee equivalent to the session’s cost.

3.3 Missed Appointments: If you fail to attend a session without prior notice, it will be considered a “no-show” and subject to the cancellation fee policy.

4. Fees and Payment

4.1 Service Fees: Fees for Services will be disclosed at the time of booking and may be subject to periodic updates.

4.2 Payment Terms: Payments are due at the time of service unless prior arrangements are made. I accept HSA, FSA, Mastercard/Visa/Discover/AMEX.

4.3 Refund Policy: Fees for completed sessions are non-refundable. Refunds for prepaid packages or unused sessions will be evaluated on a case-by-case basis. Paint from Your Soul workshops are recorded and sent to each participant, so there will be no refunds for missed events.

5. Confidentiality

5.1 Privacy Commitment: I am committed to maintaining the confidentiality of all client information in compliance with applicable laws and ethical guidelines.

5.2 Exceptions to Confidentiality: Confidentiality may be breached in circumstances where:

• There is a legal obligation to report suspected abuse or neglect.
• There is a risk of imminent harm to yourself or others.
• Information is requested through a valid legal process.

6. Client Responsibilities

6.1 Active Participation: You agree to actively engage in the therapeutic process and follow the recommendations provided during sessions.

6.2 Timely Communication: Notify me promptly of any changes in your mental, emotional, or physical health that may impact your therapy.

6.3 Respectful Conduct: You agree to maintain respectful and appropriate behavior toward therapist. Abusive or inappropriate behavior may result in the termination of Services.

7. Limitation of Liability

7.1 No Guarantees: While I strive to provide effective therapeutic services, outcomes may vary.

7.2 Limited Liability: To the fullest extent permitted by law, I am not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services.

8. Termination of Services

8.1 Client-Initiated Termination: You may terminate your engagement with my Services at any time by providing written notice.

8.2 Therapist-Initiated Termination: I reserve the right to terminate Services if:

• You fail to comply with these Terms and Conditions.
• There is a breakdown in the therapeutic relationship.
• Continuing Services is deemed no longer beneficial or appropriate.

9. Intellectual Property

All materials, including artwork created during sessions and resources provided by us, are protected by intellectual property laws. You may not reproduce, distribute, or use these materials without our prior written consent.

10. Changes to Terms and Conditions

I reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting on my website or notification to clients. Continued use of my Services constitutes acceptance of the revised Terms and Conditions.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Colorado, USA.
